Franciscan friar gets 6 months in jail for blocking New York abortion clinic entrance

Catholic priest and pro-life activist Father Fidelis Moscinski, CFR, has been sentenced to six months in federal prison for blocking access to a Planned Parenthood abortion facility by placing locks and chains on the gated entrance. 

Judge Steven Tiscione laid down the six-month sentence, which is the maximum available for the specific crime. Moscinski was found guilty of violating the Freedom of Access to Clinic Entrances (FACE) Act, which imposes harsh penalties for obstructing access to an abortion facility or a pregnancy center.

“My actions … were done because Planned Parenthood as an organization is in the business of killing,” Moscinski told the judge while asking for a lenient sentence, according to his remarks provided by the pro-life organization Red Rose Rescue. 

Although the priest is a member of Red Rose Rescue, the organization has emphasized that his effort to block access to an abortion clinic was not sanctioned by the group. Red Rose Rescue said members can engage in pro-life activism outside of their organization, but they are a sole agent when doing so. 

“Every procured abortion that occurs on [Planned Parenthood’s] premises constitutes the deliberate killing of an innocent human being,” Moscinski continued in his statement to the judge. “Furthermore, these bloody and violent acts also cause grave spiritual and psychological harm to the mother of the child. All of my actions then and now are directed solely towards preventing the murder of defenseless children and the wounding of their mothers.”

The Franciscan friar also criticized the FACE Act.

“This pseudo-law seeks to cloak the act of killing preborn children under the euphemistic and Orwellian language of ‘reproductive health care,’” Moscinski said. “I am not guilty of violating this law because this law cannot be seen as anything other than null and void since it attempts to give legal protection to actions which are intrinsically evil and unjust.”

Moscinski asked Tiscione to “somewhat mitigate the injustice this court has perpetrated” by providing him the most lenient sentence possible. Instead, the judge handed him the most severe sentence and cited his previous arrests for pro-life activism as his justification for the sentence.

The priest’s pro-life activism occurred on the morning of July 7, 2022, at the Planned Parenthood of Greater New York clinic in Hempstead, New York. He effectively shut down the clinic for about two hours by placing locks and chains on the entrance and covering some of them with glue, according to the Department of Justice.

Once the fire department and police department cut through the locks, Moscinski laid down in front of the entrance to prevent cars from entering the gate, according to a press release from the U.S. Attorney’s Office.

Moscinski has previously been arrested for his pro-life activism, but this is the first time he has been found guilty of violating the FACE Act. Last year, he was arrested for trespassing in an abortion clinic after entering the facility in protest and refusing to leave when ordered by staff and then by police. 

Earlier this month, New York Attorney General Letitia James filed a lawsuit against Red Rose Rescue that seeks to bar Moscinski and other members of Red Rose Rescue from going within 30 feet of an abortion clinic. Even though Moscinski’s FACE Act violation was not part of a Red Rose Rescue, the attorney general cited that incident as one of the incidents to justify the lawsuit.

Let us savour the "ineffable delicacy" and the mind-boggling pretentiousness of a further extract from GENE VINCENT - CLOSE UP ON A PHENOMENON - Gene's masturbatory interview with himself, supposedly conducted by Libby Purves of The Times. We left Libby in Gene's study....

Origen and Saint Justin Maryty well represented. What of course will interest me greatly is the literature - and I'm not disappointed. Such a panorama:

    Wow! Is this man literate? Or is this man literate? What I do like is the amount of literary biography. Richard Ellmann's biographies of James Joyce and Oscar Wilde and Herbert Lottman's monumental biography of Albert Camus for example. I have always thought I detected James Joyce in the delicate tapestries of Gene's writing and sure enough James Joyce is handsomely represented with the complete works including lesser-known works such as Chamber Music.

    Along one wall is stacked Gene's stereo system. Small neat and compact with headphones sitting atop the cabinet. Headphones - Gene ever thoughtful does not wish his music to disturb the rest of the family. One compact disc boxed set is also on top of the cabinet. It's Mahler: Complete Symphonies; Das Lied von der Erde, featuring Marjana Lipovsek, Ben Heppner, Gary Bertini and Kolner Rundfunk-Sinfonieorchester (2006).

    "What immaculate good taste," I say to myself."

  6. But there is worse to come....savour the complete paralysis of the power of introspection in this extract. How DOES Gene write such appalling crap with his head rammed so far up his own arse? HE COMPARES HIS PAINTING WITH "FRANK AUERBACH AT HIS BEST" !!! The only painting Gene has ever done has been up a ladder with a bucket and a two inch brush...

    As I leave his study I notice hanging on the back of the door an expensive Burberry raincoat and an elegant grey snap-brim Trilby hat. Is there a streak of Humphrey Bogart/Raymond Chandler in the rich filigree of Gene's complex make up? Let me answer that. There certainly is.

    Downstairs Gene is seated at the kitchen counter playing Danny Boy on a tin whistle. It sounds quite haunting. He suggests we conduct the interview in the living room. The living room is such a change from the kitchen - almost Victorian ambiance: chintz, dark mahogany, rich tapestry in the carpet. There are three paintings hung. Two I recognise: reproductions of Rembrandt's Christ at Emmaus and Two Travellers by Jack Yeats. A third painting I don't recognise. It walk close to examine it and see that it is titled Moonlight Over The Grand Union Canal. It's moody and expressive with thick impasto and swift brush-strokes somewhat reminiscent of Frank Auerbach at his best. I ask about it and Gene reluctantly confesses it's actually an original work by himself. "Marianne and the children insisted it be hung here. I don't think that much of it myself," he says modestly and self-deprecatingly. I demur and say, "Au contraire Gene, I think it is quite brilliant."
    We then chat a little about the Jack Yeats painting and I discover that the artist is one of Gene's favourite painters and that in fact he is currently making a study of Yeats' late works. "His brother Willim Butler Yeats, the poet, will always be better known of course. Fine poet no doubt, but as a man he could be a canting old phony - what with his Aetherius Society, his cravat and his pince-nez. Jack was more to my liking. The brothers fell out over Irish nationalism. I think they weren't on speaking terms for years. Jack was a Sinn Fein supporter while William was content to sit on the fence and then support whichever side won," mused Gene.

    I turn to sit down and it's only then I notice that one wall of the living room is entirely taken up with framed photos and images. I walk over and examine this enigmatic tableau. Gene smiles and says, "Libby, this is my hero wall. Souls who have inspired me along the way."

    What an eclectic group!
